Using ADR to Resolve Intellectual Property Disputes

Intellectual property litigation is on the rise, and so is alternative dispute resolution (ADR) to resolve these matters. In June 2019, Kyle-Beth Hilfer will leverage her years of experience as an ADR neutral to moderate two continuing legal education panels. Both panels will  consider the options for using ADR in intellectual property litigation. Ms. Hilfer will guide the panelists through explorations of mediation and arbitration to resolve a range of intellectual property disputes, including trademarks, domain names, copyrights, patents, and more. Ms. Hilfer will also lead discussions weighing the pros and cons of these ADR solutions while considering a dispute case study. Westchester County Bar Association–June 3, 2019

On June 3, 2019, the WCBA Alternative Dispute Resolution and Business & Commercial Law Committees present a continuing legal education course at 6pm entitled,New Paradigm for Alternative Dispute Resolution in Intellectual Property Litigation.” Kyle-Beth Hilfer will lead a discussion with two experienced intellectual property practitioners. In particular, with a new regime of litigation at the US Patent and Trademark Office, they will consider the emergence of strategies and procedures for alternate dispute resolution of intellectual property disputes.

The Association for Conflict Resolution’s Greater New York Chapter –June 4, 2019

The ACRGNY will hold its annual conference at New York Law School on June 4, 2019. Kyle-Beth Hilfer will moderate a discussion at 4:15pm entitled, “Intellectual Property and ADR: Resolving Disputes Away from the Courtroom.” Wearing her arbitrator hat as a panelist for the American Arbitration Association, Ms. Hilfer will converse with a mediator and a party advocate to walk through a conflict scenario. Together, the panel will unpack and analyze a variety of issues that can arise from an intellectual property dispute and explore how ADR options can benefit the unique challenges of these disputes. They will also highlight the differences between mediation and arbitration in an intellectual property dispute.
